Terms of Service

I. Acceptance Of Terms
On behalf of Team Zefferus, we would like to thank you for using our
service’s and giving us opportunity to serve you and provide you
service.
Zefferus (formerly known as Zefferus and/or Zefferus Service and/or
Zefferus Enterprises and/or ZSPL). These Terms of services are
intended to make you aware of your legal rights and responsibilities
with respect to access to use our Zefferus website, and/or use of
Zefferus mobile application with the existing i.e. present Terms or future
Terms. These Terms will be applicable to existing and future Zefferus
customers.
Please read all the Terms carefully before accepting, once accepted you are
legally bind with the Terms of contract of Zefferus. These Terms are
applicable to users like Customers, Shop vendors / Restaurant’s (when
applicable), If you don’t agree with the Terms and conditions of Zefferus you
won’t be able to use the Zefferus platform. Using Zefferus platform is at the
users risk which may include the risk of content exposed which is
inappropriate or may be objectionable.
In order to use the Zefferus Service, you first have to agree with the Terms
and you can accept the Terms by check to Terms of accept and agree to
Terms which will be made available to you while using platform. Once
accepted the Terms of Zefferus you can resume the use of service at that
point onwards.
II. Important Terminology For Reference

1) Users – Users refers to customer/ shop owner/ vendor/ restaurant
owner/ restaurant manager as applicable
2) Platform – Platform refers to application/ software/ website/ or any
other which owned as governed by Zefferus in order to provide service
as applicable.
3) Content – Content refers to documents, information, data published like
personal details, photo, videos etc as applicable

III. Amend Of Terms
Zefferus may amend or change or update these Terms from time to time in order to
make the services better for the users. It is very important to make the changes in
order to fulfil the requirements and which will help the users. It also becomes very
important for users to check these Terms time to time. The amendment / update /
changes of Terms will be bound to all the users new as well as existing.
IV. Service Users
Anyone can use service who are at least 18 years of age or above and who are fully
able to understand the Terms and legally bind with the Terms and conditions. Those
who do not violate and discreate our legal rights. By accepting the Terms user can
use the service.
V. Translation of Terms
Our Terms & Conditions are available on our website in English language and
Zefferus may provide a translation of Terms and Conditions in other language in
order to understand better and to make convenient for users.
VI. Service Facilities Offered By Zefferus And
Provision
1. Zefferus aims to provide better service to the users, in order to provide better
experience and information to the customers, we will update our platform time
to time to fulfil the needs. So, your acknowledge and agree that Zefferus is
offering, might require some intervention of changes in it. Zefferus has the
right to cancel or dis-continue any or all of the product or services with or
without notice, if needed can make modifications and changes in any or all of
the contents provided on the platform with or without prior notice.
2. Zefferus application is made available in the application store for download for
customers/users. Zefferus application and the application store require the
software upgradation and updates time to time in order to run software
application smoothly. Zefferus software application updates and upgradation
provided from us is to be considered as a part of Terms and conditions. We
may provide a notification or push notifications to update and upgrade the

software applications for better user experience time to time. You may require
certain upgradation and updates of software in order to continue access and
smooth function of the software application. This is done to make the Zefferus
platform more convenient better, enhance experience with safety and
security, to develop more features and easy to use.
3. Zefferus will continuously improve its services and platform in order to give
better services to its customers, In order to provide better service and help the
customer to fulfil the needs of customer, Zefferus may provide some offers or
may provide promotional campaign in its platform like Zefferus software
application, website or other platform owned and managed by Zefferus. This
will be managed by the Team Zefferus, This may result, some customer or
user may have difficulty in using above platform at that time. Furthermore,
Zefferus may modify or cancel and discontinue its promotion campaign or
offers without notice to the customer and users.
4. Zefferus may fix certain upper-limit of transaction at any time to the customer
or shop vendor. Zefferus as of now had not set any upper fixed limit of
transaction to its customers and shop vendors.
5. Zefferus reserves the right to terminate users account or suspend users
account or modify account or discontinue of account if there is any
engagement of activity which will be violation of Terms or fraudulent or
unlawful in nature. The user may or may not get notice for termination, and
may bound to face legal action. And by accepting the Terms and conditions
you agree that if the Zefferus disables to access account, then you give rights
to access your account details and any files or pictures which you have saved
in the account and give permission to moderate when needed.
6. By using Zefferus Services you agree on following points.
a) With our platform user can order their products/ goods. As a platform
customer can order via our websites, mobile applications. We Zefferus do
not give guarantee of the goods/ product quality, availability of
products/goods, updated price of the products/goods/menus on our
platform by Restaurant/Merchants.
b) The content used in the platform of Zefferus is for reference purpose only.
Content can be like photo’s, video’s, descriptions of the product, etc. On
the Zefferus platform the vendor can also upload the content in order to
update information about the product for the benefit of customer.
Vendor/Merchant may use some of the picture which may be freely
available on Internet portal. We as a team Zefferus disclaims such
information’s. If some uploaded content like photo, video or any other
content which will have copyright issue and have violated copyright, so
please contact and write email to us as soon as possible(You can contact
via “Contact Us” link on the home page).You can write us mail regarding
such issues and if you own such copyright and also please indicate the
URL in the mail to resolve and settle such issues. Zefferus reserves a right
to make changes or correct such content with or without prior notice.
c) In our platform all the images will have digitalized image and no other body
is authorized to republish or reproduce such digital version of image in any
format/form. If any other body or third party want to publish such digital
image so should have/take a written permission of Zefferus.
7. Zefferus does not guarantee of validation of information provided by
Merchants/Partners. All the information provided on our platform is only for

reference and information purpose. We as a Zefferus team will not guarantee
the rating, information, certificate, permit/licenses displayed on the listed
Restaurant page on our platform. We also do not warranty about any of the
products/goods displayed on our platform. Such information like rating,
certificate, permit/licenses displayed by us is ‘as on available’ basis provided
by Restaurant partner/Merchant. If you find that the displayed rating,
certificate, permit/licenses and information are invalid, manipulated and
inaccurate so please reach to us via “Contact us” link on the home page. We
assure that appropriate action will be taken in such case and if applicable
Restaurant partner/Merchant will be liable to face local laws and or national
laws and or international laws or regulated bodies as applicable. Zefferus is
not liable to pay any of the liabilities or losses or damage incurred by such
information like rating, certificate, permit/licenses displayed on our platform
provided by Restaurant partner/Merchant.
8. In order to provide service in any product to its customers, Zefferus reserves
the right to charge membership fee or convenience fee or subscription by
providing notice on the Zefferus platform in anytime in Future. Furthermore,
Zefferus may provide and introduce some offers (if any) for customer and by
participating in such program, customer are bound with the Terms and
condition for such program and Zefferus reserve the right to modify,
discontinue or cancel program without prior notice to its customer. Zefferus
reserve the right to terminate/suspend the customer’s account if finds that
customer have violated and or involved in fraudulent activity and or the rules
of the program. By acknowledging the term and condition by users you give
rights to Zefferus to terminate/suspend the customer’s account and or all the
credit earned and or points earned and or E-Wallet pre balance will be lapsed
VII. Service used by User / Customer via Zefferus
platform
1. First user / customer must create an account in order to use service provided
by Zefferus. User / Customer must fill all the details required for login and also
should update when demanded for additional documents. If you are using the
social media or social networking sites for registration so you confirm that you
are owner of the account and giving authority / rights to collect authentication
information and hence you may be entitled to disclose the login information to
us. After creating account user / customer must agree the Terms governed by
our Privacy Policy. User / Customer must keep their password safe and it
should be confidential and user/ customer is the solely responsible for making
it confidential.
2. While creating your account the information which you have provided should
be true and you are truly responsible for accurate information and you will
update information when it is demanded or made it necessary for latest
update. While creating your account you claim that you are the authorised
owner or managing the account for use. We pretend that you have not shared
your login credentials to someone else for using it on your behalf. If you think
that your login credentials are used by someone other than you so it becomes
your responsibility to change the login credential like password etc. and you

can write mail to us and also please reach to us via “Contact us” link on the
home page. Zefferus will not be liable for any kind of loss incurred or any
damage or losses. You also agree that you will not share or allow any third
party to use Zefferus platform for any purpose or mean which will be
accountable for Unauthorized access. You are responsible for all the activity
incurred in your account and you are solely responsible to notify us so that
Team Zefferus can take appropriate and correct action if possible.
3. By creating account on Zefferus platform, there may be possibility that you
can send feedback or comment or message or provide necessary rating to
vendor / merchant business and also you can follow merchant / vendor
business account.
VIII. Service used by Vendors / Merchant account for
Business listing via Zefferus platform
1. First vendor / merchant must create an account in order to use service
provided by Zefferus, vendor / merchant must fill all the details required for
login and also should update when demanded for additional documents. If you
are using the social media or social networking sites for registration so you
confirm that you are owner of the account and giving authority / rights to
collect authentication information and hence you may be entitled to disclose
the login information to us. After creating account vendor / merchant must
agree the Terms governed by our Privacy Policy. Vendor / merchant must
keep their password safe and it should be confidential and Vendor / merchant
is the solely responsible for making it confidential.
2. While creating account of business listing the information which you have
provided should be true and correct and you are truly responsible for accurate
information and you will update information when it is demanded or made it
necessary for latest update. While creating account of business listing you
claim that you are the authorised owner or managing the account for business
purpose. We pretend that you have not shared your login credentials to
someone else for using it for business purpose on your behalf. If you think

home page. Zefferus will not be liable for any kind of loss incurred or any

Team Zefferus can take appropriate and correct action if possible.
3. By creating account of your business, there might be possibility that you may
receive feedback or comment or message or necessary rating from customers
and also may be possible that the customer may follow your business
account. Zefferus may provide an option to manage your preference
regarding such communication and you can follow option to refrain in your
account setting.

IX. Some other Terms which are applicable for user
while using Zefferus platform
1. As you are using Zefferus platform and you agree that you will not do any
such activity or disrupt or interfere in any such activity that will effect on the
service. You also agree that you will not be spamming, or delete or revisit any
information material posted by any of the customer. You will not be engaged
in such activity that will hamper or disrupt the reputation or the service of
Zefferus.
2. You also agree that you will not dilute the face value and image of any of the
restaurant / vendor/ merchant through Zefferus platform by any mean. You
also agree that you will obey the rules and regulation offered by them.
3. As we understand that while placing order from Zefferus platform you may
require the Vendors / Merchant details in order to get connected as and when
needed, so you can find the contact details displayed on the page of the
restaurant listing page. In future Zefferus may record the phone call and the
conversation held between you and the vendor / merchant. By using our
Zefferus platform you agree and give us permission to do (if possible). If you
don’t wish that the conversation should be recorded so request you to not to
use telephone service provided on the Zefferus platform. We may record
conversation in future for internal quality purpose and also this may help for
improving our service.
X. Content on Zefferus Platform
1. Ownership of the Content and Proprietary Rights
A. We Zefferus has the sole and exclusive copyright owners of the Services
and has the sole and exclusive copyright owners of our Content. We also
exclusively own the copyrights, logos, trade names, trade dress,
trademarks, service marks, and other intellectual and proprietary rights
throughout the world associated with the services and Zefferus content,
may be protected by the copyright patent, trademarks. You further
acknowledge that the Services may contain information which is
designated as confidential by Zefferus and that you shall not disclose such
information without Zefferus prior notice and also in written consent. You
further acknowledge that the Services contain original works and have
been compiled, developed, prepared, selected, revised, and arranged by
us and others through the application of methods and standards of
judgment developed and applied through the expenditure of substantial ,
effort, money, time, and constitutes valuable intellectual property of us and
such others. You agree not to use any technique by framing logos like
logos with changing colour, size, copying and or modifying logo, other
information of Zefferus any such activity of exploiting and violation such
shall lead to legal proceeding. By accepting Terms you agree to protect
Zefferus proprietary rights during the service and after the Terms of this
agreement.

B. You further acknowledge that the Services may contain information which
is designated as confidential by Zefferus and that you will / shall not
disclose such information without Zefferus prior notice and also written
consent. Unless you have agreed otherwise in writing with Zefferus,
nothing in the Terms gives you a right to use any of Zefferus trade names,
logos, trademarks, domain names, service marks and other distinctive
brand features.
C. Zefferus neither warrant and represent that the information used in our
platform to displayed will not infringe rights of the third parties and not
owned by and or affiliated with us. If you find while using our platform you
agree to immediately intimate and notify us aware of any claim that the
services infringe upon any of the copyright trademark intellectual
contractual, common or statutory law rights etc.
Infringement
We respect the intellectual rights of others and those who use the services to
do same. We as Zefferus shall not be liable for any infringement copyright
arising out on posted materials on our Zefferus platform or any transmitted on
Zefferus Platform by users or by third parties. We as Zefferus reserves the
right to remove, disable access of the material on our platform where there is
an infringes material, infringes activity or copyrights of others. In the event, if
any Customers repeatedly infringe on others' copyrights, we may terminate
those individuals' rights to use the services If you believe that your copyright
have been or is being infringed upon by material found, we request you to
follow the below procedure and require to file a notification:-
(a) Identify in writing that the copyrighted material that you claim has been infringed;
(b) Identify in writing material that on Zefferus Platform that you claim the infringing on
copyrighted material and provide necessary and sufficient information that identifies the
location of the claimed infringing material ;
(c) Would request you to include the statement:- “ I have a good faith belief that the use of
the content on the service as described above is not authorized by the copyright owner,
its agent or law” ;
(d) Would request you further to Including the statement:- “I swear under penalty of perjury
that the information in my notice is accurate and I am the copyright owner or I am
authorized to act on the copyright owner's behalf” ;
(e) We request you to please write to us with subject:- Infringement/Violation Issue
(f) We request your to provide your physical or electronic signature ;
(g) We further request to provide information including your communication details like your
name, your communication number or telephone number, your mail id, your address ;
(h) We would like to receive a written communication for Infringement to documents
zefferus.documents@gmail.com
You may be also further subject to liability if you knowingly make any mis-representation
on take down notice.
2. Your license on Zefferus platform contents
Any violation on following license provisions contained in the section by you
may result to terminate of your rights to use the service on immediate basis,
further your acknowledge of Terms states that liability incurred (if any) for
copyrights and other rights by infringe depending on the situation and
circumstances. Zefferus grants you a limited, personal, non-exclusive and

non-transferable license to use and access platform and services only if
expresses to and agrees to permit these Terms. You will use Zefferus
platform and it’s information for your personal and non-commercial use and
not for any Illegal purpose. You will not copy, modify, use, display, distribute,
incorporate, reproduce, reformat, translate any of such into advertisements
and will not sell, promote, will not create any of the derivative works to exploit
in any way or in any other way to exploit Zefferus content whole or in a part. It
will be exceptional case when Zefferus grants a written permit but we don’t
give any such written permission as of now.
3. Zefferus License to and Represents Your or Customer
Content and Customer Reviews
In consideration of availing the Services on the Zefferus Platform and by
submitting your Content, you grant us the right to use the name or username
that you submit in connection with your content. On Zefferus platform you are
solely responsible for the content published by your account. You are the sole
you owner, author and controls all of the rights of your content. You warrant
and represent that you are the sole owner, managing account. If the content
which you have published is of review, so the review must be accurate based
on the service used and experiences and it should be a honest opinion, and
your review posting will not be paid review, or will not have any connection
with paid publish by any mean. The Content which is published from your
account is not published via automated process and it is not be copied from in
whole or to some part from Internet and every review posted on Zefferus is
the personal opinion of the customer or reviewer only. The content which you
have provided on our platform does not violates the Terms and conditions and
or any applicable laws and the content which you have provided on our
platform is correct, true with accurate. We as Zefferus do not have control on
posting and action published by customer, and we do not guarantee the
published information is accurate or right. By acknowledge the Terms, if any
liability incurred by the posting so Zefferus will stand and have a neutral
platform and will not be responsible, the sole responsibility will be of the
customer who had posted the content and published via Zefferus platform.
We are providing a communication medium between customer and the seller
i.e. vendor / merchant etc with the help of Zefferus business page. If any
published content which is not as per Zefferus Terms and condition so we
condemn and if there is any such published so please contact and write email
to us as soon as possible (You can contact via “Contact Us” link on the home
page) You can write us mail regarding such issues and if such publishment is
objectionable and it violates the Terms and condition of Zefferus and also
please indicate the URL in the mail to resolve and settle such issues. Zefferus
as well as Restaurant vendor / merchant reserves a right to remove or correct
such content from the page with or without prior notice.
